Hello SHL,

We have received an appeal from @DarthDaevin regarding this punishment.

While we understand the spirit of the rule that IIHF HO is using for this punishment, we feel this is a very granular application of the rule and does not meet the requirements for a punishment. First, the tampered user in question did not create a player, meaning no harm was truly done. Had that player created, and created for Latvia, there may have been an argument for a punishment, but in current state this is a punishment for a non-existent player, which the committee does not feel is fair. In addition, looking at the precedent punishment used by IIHF HO, Popol’s punishment for tampering 3 players was only a punishment for France, with Popol receiving no personal punishment. Looking at the Sparky punishment from 2021 that IIHF HO later cited, there was a tangible player that was tampered, and Sparky himself was a Federation Head, which we feel are big differences here.

In conclusion, while we understand where IIHF HO was coming from, we feel that no harm was ultimately done with DarthDaevin’s communication to a prospective user, as said user did not create, and no long term damage can be attributed to Daevin. Therefore, we are Overturning DarthDaevin’s suspension, and he will not be suspended for the upcoming IIHF tournament. I might get some people who disagree with me but i feel like it being a punishment and then appealed away was the right outcome and the best outcome. I am happy how this ends up

I think a problem with this appeal is that it references the outcome of the rule breaking and not the rule breaking itself, I think looking at past punishments we usually cite whether or not a rule was broken not if nobody was hurt. I vote we fully punish Darth Daevin

It was quite the journey but I'm glad that we finally made it to a reasonable outcome to this whole situation.

Here's the issue. I'm sitting on the couch petting my dog, I tell say to my dog "Wouldn't it be fucking wild if you had a player named Air Bud and joined Latvia so I could skate with my dog in the IIHF?" THAT would be tampering. The theoretical of a character creation shouldn't be part of the rulebook to begin with. Once a player is created, even if not approved, it's fruit of the poison tree. Before a character even exists though? It's a bridge too far.
