If you look at the Consolidated SMJHL Rulebook, under Section II. Player Rules, D. Send Down Status it reads:
6. A player may not redistribute previously-applied TPE to the bank to meet the 350 TPE cap.

This is the rule you were looking for. Once more than 350 has been applied, it can't be redistributed to meet the 350 cap again. So technically he's not eligible to play in the SMJHL anymore. It doesn't explicitly say that he's called up, but I think that's implied by being ineligible to play juniors.
