The buyout rule says it can only be done during the off season though. So....wouldn't that mean that Portland announced their intention to use their buyout in accordance with the rules in the off season making Alex a free agent when the free agency period opens in the off season?

The definition of tampering has always been "did this action happen outside of public view and did it give one team an unfair / early advantage in negotiations or sway a member to join a particular team"

In this case it's hard to see how this doesn't meet that standard. Look at the case of Mac and NEW. Mac sent a PM saying "talk to me when free agency opens" and it was tampering. How could this not be?
