None of these 2 applies to this current situation since this particular person never created nor signed up to the site. Therefore, I can't see why you can use this as ground for punishment for tampering.

Rule 6. n. applies to prospective users as well. The wrong rule was quoted in the original post. Arty has addressed this in an above post.
