So what happens with these players if their SHL does not want to play them, does their contract count towards the normal SHL cap because they are not really send-downs because they do not play for a SMJHL team. So literally dead weight?

Maybe it's time to clearly declare who actually is considered to be a SMJHL player in the rulebook? Is a FA who has not signed considered to be a SMJHL player? Logically it seems like such player shouldn't be one. And that would conflict with rules like

All players begin their career in the SMJHL

A SMJHL player must enter the SHL via draft. A player may not bypass the SMJHL and sign directly to an SHL team.

SMJHL Rookies may purchase SMJHL Equipment which gives a permanent boost to TPE

IMO there is just too little information on this in the rulebook. The bosses of the league should make a statement regarding this particular case and right after that update the rulebook so everyone would clearly know if they can actually do something like this and what would be the consequences of that.

I think that a free agent shouldn't be considered a SMJHL player/rookie, but he/she should be eligible for the SHL draft. However, their training options should be limited. It just makes sense that they could obviously do ITC's and write media, but since they technically wouldn't be a part of the SMJHL, they shouldn't be able to do SMJHL point tasks, championship week, all that stuff.
