REG Early Signing & No Payment Punishment

Howdy everyone.
On March 16th at 10:07AM EST, the Regina Elk posted in the SMJHL Roster Transactions subforum. While the original content of the post is unconfirmed, it is alleged it was a signing for Oleksander Olli O’Koivu, @Wally and releasing an IFA, Ryland Bunnell @RylandBunnell18. The post was edited at 10:30AM EST to its current state, which is just the release of Ryland Bunnell. At 7:15PM EST, REG then posted again in the same subforum and then edited the post to its final state, a FA contract for Oleksander Olli O’Koivu. While SMJHL HO was aware of the allegations of an illegal early contract post, it was not until REG approached HO of their own volition on March 24th, during the middle of the fourth day of the S64 regular season, to admit the post did happen that we had any proof. Unfortunately, this has caused a multitude of issues. First, this is a situation of an illegal contract being posted, which precedent requires the contract to be voided and the player in question to return to FA. Difficulties arise immediately as this opens the question of if the contract signed was valid, and if not, does that constitute a situation where REG was playing an illegal roster as they had an illegally acquired player on it? In addition, the only reason we’re able to act on this is because of REG coming forward of their own will. This complicates matters further as we don’t want to disincentivize teams coming forward and admitting mistakes. Punishing good faith decisions will only make teams more hesitant to admit mistakes in favor of hoping to avoid a punishment received regardless. And yet, REG admitted they knew from the beginning and withheld it thinking that HO would approach them first, waiting for over a week and multiple regular season days to come forward. Even more, punishing a player who didn’t even sign an illegally posted contract outside of their control and requiring them to potentially sit for a day as they wait out the standard FA process to re-sign with their original team or sign elsewhere to not miss a day would be excessive. We considered all of this and other factors such as the overarching context through multiple days of discussion and deliberation. However, one additional thing to note. In our investigation it was discovered that REG did not pay Wally for their contract. Per some of our most recent rule rewrites and 9.E.a.i, the failure to deposit a contract for a player who has played 1-32 games is a $2mil fine to the GM & Co-GM of the team. In the end, J HO has voted for a first instance of a violation of 9.J for a $2mil fine for posting an early contract post and a violation of 9.E.a.i for a $2mil fine for not paying a player who has played games for the team, for a $4mil total GM & Co-GM pay deduction. In addition, Wally will re-enter FA and be able to sign with any team except REG immediately as of this post, and may re-sign again with REG 24H after this post. HO did not feel that there existed a current illegal contract guideline that appropriately fit this situation, and applying any existing guidelines would result in an overreach or an improper application of the intent of certain rules. HO will be discussing and looking to add a ruling to cover future situations of teams utilizing players with illegal contracts. As always, @lespoils and @Thunder39 are free to appeal either, neither, or both of the decisions, should they wish.
