Result of Buffalo Appeal

Decided by myself and <a href='index.php?showuser=12' rel='nofollow' alt='profile link' class='user-tagged mgroup-4'>Leafs4ever</a>

Official decision: The correct punishment has been applied to Buffalo, aside from one area. The 1st round pick should not be up to them as for when it is forfeited. As this is a punishment, their first available 1st round pick should be forfeited. This means that the S34 1st held by Buffalo is FORFEITED.

*CORRECTION: Pick year was wrong initially. The forfeited pick is in S34, which is the 7th overall pick.

Reasoning: In reading the appeal, it is our opinion that the decision reached by the head office is just and fair. Though the rulebook does not mention such nuance, it is clear that the infraction committed by Buffalo has one mitigating factor that makes it clear this is not a typical tampering case. This being that ThatDamnWalrus demonstrated due diligence in clarifying whether or not Laing could be contacted by an opposing GM. The information he received from RomanesEuntDomus was incorrect. By contacting a member of the head office, who should have known the rule, ThatDamnWalrus could have felt assured that he was not tampering. Thus, as it was not in the full spirit of the tampering rule, which seeks to punish teams trying to knowingly circumvent free agency, Buffalo should not face the full extent of the punishment.

However, it is clear that tampering did still occur. While Portland had already agreed to buy out Laing and Buffalo had no intention to sign him, it is not permissible to contact an upcoming free agent. The announcement posted by Wally, presently, does not have any ambiguity in its language and is clear that Laing remained on Portland until the free agent period. Though the thread was moved to completed transactions, the placement of the thread has no bearing in how clear or unclear the message posted by Wally was. Additionally, the rule on compliance buyouts - regardless of whether it was quoted in the thread or not - is posted for all to see in the rulebook. Had ThatDamnWalrus consulted the rulebook, he would have seen the rule being quite clear that compliance buyouts can only be performed in the offseason. Thus, fault certainly lies with Portland to some degree for posting the transaction early. However, this does not clear Buffalo in this instance. While the compliance buyout is an unusual transaction in the SHL, tampering has always been seen as contacting a forthcoming free agent regarding contract demands or joining the offending side's team. While the compliance buyout may cause some confusion due to its rarity, ThatDamnWalrus should have known that contacting Laing before the free agent period is against the rules and would be punished as tampering.

Defined as "approaching a player under contract with another team outside of the public forums, with the purpose of persuading them to join your team", tampering could be argued to have not occurred. ThatDamnWalrus has argued that there was no intent to sign Laing and evidence submitted by both he and RomanesEuntDomus from the team's discord server make it clear, in areas, that there was no intention to sign Laing. Through contacting him and querying as to his asking price, the Stampede hoped to determine which teams could actually afford him. From a competitive standpoint, this is logical. However, by contacting him and asking for a salary price, Buffalo sought to create a competitive advantage over other SHL teams and had the intent of having inside and advanced information regarding the pending free agency of a player. Thus, while there was not an intent to persuade Laing to join Buffalo, there was intent to benefit from the knowledge of how much Laing intended to ask for. Thus, while some lee-way is offered from the standard tampering punishment for not being completely to the letter of the law and the result of misinformation by a head office member, the lack of understanding and ignorance of the rules demonstrated by ThatDamnWalrus do not fully exonerate he or his team. While the rule may read that there must be intent to sign, prior precedent and the application of the rule both demonstrate that the mere act of contacting a free agent regarding their impending free agency or trying to gain a competitive advantage by doing so is in fact tampering.

Still disagree. It is the person in HO's fault only.

If a GM gets approval to do something from HO, they should no longer have to accept responsibility. RED should have been removed from HO and BUF should have been left alone.
